Terms & Conditions of business

Wyndon Motors Ltd will only carry out work on the basis of these Terms and Conditions. By authorising or allowing us to work on a Vehicle, or by leaving a Vehicle in our possession for any length of time, the Customer/Owner/Driver/User is deemed to have accepted them in full. No alternative terms will apply unless agreed in writing.

This agreement is between Wyndon Motors Ltd (“the Supplier”) and the Customer.

1. Definitions

1.1 The Customer means the person, firm or company authorising Wyndon Motors Ltd to carry out services on the vehicle.

1.2 Services means the repair, restoration, painting or servicing of vehicles and any other work carried out by Wyndon Motors Ltd, including vehicle storage and, where applicable, the provision of a courtesy vehicle.

1.3 Completion Date means the estimated date when the Services are expected to be completed.

1.4 The Vehicle means the vehicle left with Wyndon Motors Ltd for repair or service.

1.5 By leaving the Vehicle with Wyndon Motors Ltd or authorising work to begin, the Customer confirms they are the legal owner or are authorised by the owner to enter into this agreement and request that work commences as soon as reasonably possible.

2. Estimates

2.1 Any estimate provided is based on visible damage only and is therefore provisional.

2.2 Additional damage may be identified once panels or components are removed during the repair process.

2.3 Where further work or parts are required, the Customer or insurer will be notified and approval obtained where reasonably practicable before proceeding.

2.4 Estimates do not constitute a binding agreement to undertake the work.

2.5 A charge may apply for detailed estimates where dismantling or significant inspection time is required.

2.6 All parts prices included within the estimate are subject to change in accordance with manufacturer pricing at the time of ordering. As such, final part costs may differ from those originally quoted. Wyndon Motors Ltd reserves the right to charge the updated price, and a supplier invoice can be provided to support any increase, for which the customer or insurer will remain liable.

3. Hidden Damage

3.1 During the repair process, additional damage may be identified that was not visible at the time of initial inspection.

3.2 Where further work is required to repair the Vehicle safely and to an appropriate manufacture standard, Wyndon Motors Ltd will notify the Customer or insurer before proceeding where reasonably practicable. Wyndon Motors Ltd will not compromise safety or the manufactures guidelines to decrease costs. Further details can be made available upon request.

3.3 Any additional work may affect both the final cost and Completion Date.

4. Safety and Repair Restrictions

4.1 Wyndon Motors Ltd reserves the right to refuse to carry out any work that may render the Vehicle unsafe or compromise its structural integrity.

4.2 Wyndon Motors Ltd reserves the right to refuse to road test any Vehicle that is not in a legal or safe condition for use on public roads. Certain systems may remain inoperative where their calibration or testing requires a roadworthy Vehicle. Wyndon Motors Ltd will not carry out any procedure that could place its staff, the public, or its licences at risk. Where dynamic calibration (including but not limited to radar systems) cannot be completed due to the condition of the Vehicle, this will remain outstanding until the Customer ensures the Vehicle is made safe and compliant. Upon rectification, calibration can then be completed.

5. Subcontracted Work

5.1 Certain specialist services may be carried out by approved third-party contractors.

5.2 Wyndon Motors Ltd will take reasonable care to ensure such contractors are suitably qualified and competent.

5.3 Responsibility for the outcome of subcontracted work remains with Wyndon Motors, subject to applicable law.

6. Replacement Parts

6.1 Unless otherwise agreed, Wyndon Motors Ltd will supply parts sourced from manufacturers or approved suppliers only.

6.2 Any parts replaced during the repair process shall become the property of the insurance company where the repair is being carried out under an insurance claim. Where the Customer is funding the repair privately, removed parts may be returned upon request, provided this is agreed prior to commencement of work.

6.3 For private paying funded repairs, all replacement parts remain the property of Wyndon Motors Ltd until full payment has been received.

6.4 All parts supplied are subject strictly to the manufacturer’s warranty terms. Wyndon Motors Ltd does not provide any additional warranty beyond that offered by the manufacturer and accepts no liability for any extension of such warranties.

7. Paintwork and Colour Matching

7.1 Wyndon Motors Ltd uses professional paint systems and, where applicable, manufacturer-approved materials.

7.2 Due to factors including age, UV exposure, previous repairs and environmental conditions, an exact colour match cannot be guaranteed.

7.3 To achieve the best possible finish, blending into adjacent panels may be required.

7.4 Wyndon Motors Ltd provides a lifetime paintwork warranty for as long as the Customer retains ownership of the Vehicle. This warranty is non-transferable and subject to reasonable care and maintenance of the paintwork.

8. Completion Dates

8.1 Any Completion Date provided is an estimate only.

8.2 Wyndon Motors Ltd shall not be liable for delays caused by additional damage, parts availability, insurer approvals or any circumstances beyond its reasonable control.

9. Parts Availability

9.1 Delays may occur due to manufacturer or supplier issues, including backorders or discontinued parts.

9.2 Wyndon Motors Ltd accepts no liability for delays arising from parts supply issues outside of its control.

10. Insurance Repairs

10.1 Where repairs are carried out under an insurance claim, Wyndon Motors Ltd may liaise with the insurer on behalf of the Customer.

10.2 Repairs may be subject to insurer approval and policy terms.

10.3 The Customer remains responsible for payment of any excess, VAT (where applicable), or any costs not authorised or settled by the insurer.

11. Non-Fault Accident Repairs

11.1 Wyndon Motors Ltd may assist with claims via approved accident management companies.

11.2 The Customer must provide accurate and complete information relating to the incident and all parties involved.

11.3 The Customer remains liable for any charges not recovered from the responsible party or their insurer.

12. Vehicle Collection

12.1 The Customer will be notified when the Vehicle is ready for collection.

12.2 Vehicles should be collected within 24 hours unless otherwise agreed in writing.

12.3 Wyndon Motors Ltd may drive or road test the Vehicle as necessary to complete repairs and quality checks.

12.4 A charge may be applied where additional fuel is required for testing purposes.

13. Payment

13.1 Full payment must be made prior to release of the Vehicle unless otherwise agreed in writing.

13.2 In insurance repairs, the Customer remains responsible for any excess, VAT or outstanding balances.

14. Storage

14.1 Vehicles not collected within 24 hours of notification may incur storage charges.

14.2 Storage charges may also apply where there are delays in repair authorisation and the Vehicle remains on site.

15. Courtesy Vehicles

15.1 Any courtesy vehicle must be returned immediately upon notification that the repaired Vehicle is ready.

15.2 Failure to return a courtesy vehicle within 24 hours may result in daily hire charges at BVRLA guidelines.

15.3 The Customer is responsible for any fines, penalties, damage or loss incurred during use of the courtesy vehicle.

15.4 In the event of damage to a courtesy vehicle, the Customer must notify Wyndon Motors Ltd immediately and comply with all insurance requirements, including completing all necessary claim documentation and paying any applicable excess. Any costs not covered by insurance shall remain the responsibility of the Customer. Failure to comply may result in Wyndon Motors Ltd recovering all associated losses through legal means. Wyndon Motors Ltd reserves the right to retain the Customer’s Vehicle until all costs have been settled in full or the claim has been formally accepted by the relevant insurer.

16. Right of Retention

Wyndon Motors Ltd reserves the right to retain possession of the Vehicle until all sums due have been paid in full.

17. Liability

17.1 Wyndon Motors Ltd will take reasonable care of the Vehicle while in its custody.

17.2 Wyndon Motors Ltd shall not be liable for:
(a) any loss or damage to personal belongings left in the Vehicle
(b) any pre-existing faults, poor prior repairs or underlying issues that become apparent during or after repair
(c) any indirect or consequential loss
17.3 Customers are advised to remove all personal belongings prior to leaving the Vehicle.

    18. Inspection on Collection

    18.1 The Customer must inspect the Vehicle upon collection.

    18.2 By taking possession, the Customer confirms satisfaction with the completed work unless any concerns are raised at that time.

    18.3 The Customer is required to take all reasonable and practical steps to inspect the Vehicle upon collection and to report any issues or concerns without delay, including any damage or condition they believe was not present prior to repair. Whilst certain defects may only become apparent after a period of use, any visible, apparent or reasonably identifiable concerns (including but not limited to scratches, panel alignment, paint finish or general condition) must be reported immediately or, at the latest, by the next working day. Notification may be made outside of business hours (including by email) and will be reviewed as soon as reasonably practicable. Wyndon Motors Ltd reserves the right to decline any claim where there has been a failure to report within a reasonable timeframe and where the Vehicle may have been subject to further use, environmental exposure, third-party interaction or any other factors beyond the control of Wyndon Motors Ltd.

    19. Payment Disputes

    19.1 The Customer agrees to contact Wyndon Motors Ltd directly to resolve any concerns before initiating a chargeback or payment dispute.

    19.2 Wyndon Motors Ltd will make reasonable efforts to resolve any genuine concerns.

    20. Consumer Rights

    Nothing in these terms affects the Customer’s statutory rights under UK consumer law.

    21. Governing Law

    These terms shall be governed by and construed in accordance with the laws of England and Wales.
